Terms Of Service

1. License and Usage:1.1. Unless explicitly agreed upon in a separate written agreement, all commissioned artwork is intended for personal, non-commercial use only. The Client is granted a non-exclusive, non-transferable license to use the artwork for personal display, including as profile pictures and banners.
1.2. Any commercial use, including but not limited to reproduction for sale, marketing, or promotional purposes, requires a separate commercial license agreement and the payment of additional fees. Interested parties should contact the Artist via email or the initial method of communication to discuss commercial licensing terms.
2. Intellectual Property Rights:2.1. The Artist retains all intellectual property rights, including copyright, in and to the commissioned artwork.
2.2. The Client is expressly prohibited from inputting the commissioned artwork into any artificial intelligence (AI) engine or utilizing it for AI training purposes.
3. Artist's Rights:3.1. Unless explicitly requested otherwise by the Client in writing, the Artist reserves the right to post the commissioned artwork on their social media platforms and include it in their professional portfolio.4. Pricing:4.1. The listed prices represent the base price for commissions. The final price is subject to increase based on the complexity of the subject matter, the level of detail required, and any additional specifications requested by the Client. The Client will be informed of any price adjustments prior to the commencement of work.5. Right to Refuse Commission:5.1. The Artist reserves the right to decline any commission request at their sole discretion, including but not limited to instances where the Artist believes their skill level may not adequately meet the Client's requirements or if the subject matter falls outside the Artist's acceptable scope.6. Timeline and Rush Orders:6.1. The Client acknowledges that the creation of high-quality, detailed artwork requires time and patience. The Artist requests a reasonable timeframe of at least three (3) months between each major stage of the commission (e.g., sketch, flat colors, line art) to accommodate unforeseen circumstances and ensure the quality of the final product.
6.2. Rush orders with specific deadlines may be accommodated at the Artist's discretion and will be subject to additional rush fees, which will be communicated to the Client and must be paid in advance.
6.3. The Client is welcome to inquire about the progress of their commission. The Artist typically provides updates at the rough sketch, flat colors, and final check phases.
7. Attribution:7.1. When reposting or sharing the commissioned artwork, the Client is requested to provide proper attribution to the Artist by crediting "@jamethedealmaker".8. References:8.1. The Client is required to provide visual references for the commission. Non-visual references may result in additional fees or the declination of the commission. Comprehensive visual references enable the Artist to better understand and fulfill the Client's request, minimizing the potential for errors.9. Payment Terms:9.1. Preferred payment method is via CashApp; however, alternative payment methods may be available upon request.
9.2. A non-refundable retainer of twenty-five percent (25%) of the total invoice amount is due upfront. An additional fifteen percent (15%) of the total invoice amount is due upon completion of the color flats stage. The remaining balance shall be paid upon delivery of the completed commission.
9.3. Fees for rush orders, if applicable, must be paid in full prior to the commencement of work.

10. Refunds and Cancellations:10.1. In the event that the Artist is unable to complete the commissioned work, the Client will be eligible for a full refund of all payments made.
10.2. If the Client chooses to cancel the commission, they will be eligible for a refund of seventy-five percent (75%) of the total payment received, excluding the non-refundable retainer. Refund requests may be made at any time prior to the delivery of the finished product.
11. Client Conduct:11.1. The Client is expected to communicate respectfully and professionally with the Artist. Any aggressive, rude, or inappropriate behavior towards the Artist may result in the immediate cancellation of the commission without the standard refund.12. Process and Revisions:12.1. Upon commencement of the commission, the Artist will provide progress images of the sketch, line art, flat color, and shading stages for the Client's review and approval or to facilitate minor revisions before proceeding to the next stage. The Client's confirmation is required at each stage to continue the work.
12.2. Upon completion of the artwork, a final version will be submitted to the Client for review. The Client is entitled to request up to three (3) minor revisions. Any revisions beyond the initial three (3) will be subject to an additional fee, which must be paid in full before the adjustments are made.
13. Final Delivery:13.1. Once the finalized artwork is accepted by the Client, the Artist will deliver the high-resolution digital files in the requested format. No physical product will be provided.14. Agreement to Terms:14.1. By commissioning the Artist, the Client acknowledges that they have thoroughly read, fully understand, and unequivocally agree to be bound by these Terms of Service and the terms outlined in the invoice.
